Terms & Conditions

These terms cover buying from Gurkhas Mart on this website. Please read them before you order — placing an order means accepting them.

They are written to be read. Nothing in them takes away the rights Romanian consumer law gives you, and where a term below and the law disagree, the law wins.

Who you are buying from

Gurkhas Mart is a grocery shop in Romania selling Nepali and South Asian food. There is a real shop with real shelves, and this website sells from the same stock.

These terms

The version published when you place an order is the version that governs it. We may change these terms — prices, products and the law all move — but a change never applies backwards to an order we have already accepted.

If any part of these terms turns out to be unenforceable, the rest of them still stand.

Your account

You can browse the whole shop and fill a basket without an account. Checking out needs one, with an email address you have confirmed using the one-time code we send you. That is what keeps your orders, your saved addresses and any return you make attached to the right person.

Please keep your details accurate, particularly the delivery address and phone number — a courier cannot deliver to an address that no longer exists, and we charge for a second attempt.

Your password is yours to look after. Tell us straight away if you think someone else has it. One account per person, please.

We may suspend or close an account used for fraud, abuse of our staff, or repeated cash-on-delivery orders that are never collected. You can close yours whenever you like; we keep the records of orders already placed for as long as tax and accounting law requires.

What we sell

Every food product page carries the information EU food law requires when food is sold at a distance: its allergen declaration, its ingredients, the net quantity, and — where the item is sold by weight or volume — the price per kilogram or litre. Nothing edible goes on sale here until the allergen field has been filled in.

That information comes from the manufacturer's own packaging and we keep it current. Recipes do change, though, and the pack in your hand is the authority. Please read it before eating anything you are allergic to. If the pack and the page disagree, the pack is right — tell us and we will correct the page.

Photographs are there to help you recognise a product. Manufacturers redesign packaging without telling anyone, so the pack that arrives may not look exactly like the picture. What we are selling you is the product described, at the weight or volume stated.

Stock is not guaranteed until we accept your order, and we may limit how much of a scarce item one order can take so that it reaches more people.

Prices and VAT

Prices are in Romanian lei and include VAT. The price on a product is the price you pay for it; delivery, if you are not collecting, is added in the basket and shown before you pay anything.

Romanian VAT is charged per product rather than at one rate for the whole shop — most groceries sit at the reduced food rate, while alcohol, food supplements and high-sugar items are charged at the standard rate. The rates themselves are set by law and change when Parliament changes them. Your receipt shows the split that applied to your order.

The price shown when you place an order is the price for that order, even if it changes afterwards.

Very occasionally something is priced wrongly — a decimal point in the wrong place, a weight entered as a price. Where the error is obvious and you could reasonably have spotted it, we are not obliged to supply at that price. We will tell you before doing anything, and you can either confirm the order at the right price or cancel it and be refunded in full.

Placing an order

Adding things to a basket and going through the checkout is an offer to buy them. The email that lands immediately afterwards confirms we have received that offer — it is not yet acceptance of it. The contract between us exists when we confirm the order is accepted and being prepared.

We may decline an order. The honest reasons are these:

  • something in it turns out not to be in stock
  • we cannot deliver to the address given
  • the payment was not authorised
  • the order includes an age-restricted product and we are not satisfied about age
  • a price or a product description was obviously wrong
  • we have good reason to believe the order is not genuine

If we decline an order you have already paid for, you get all of it back.

Paying

You can pay by card, by PayPal, or in cash to the courier who brings the order. Cash on delivery is offered only for billing addresses in Romania, because a courier elsewhere cannot collect it.

Card numbers are typed into the payment provider's own form and never reach this website. We do not see them and we cannot store them.

If you need an invoice for a company, tick "I need a VAT invoice for a company" at the checkout and fill in the company name, its CUI and its Nr. Reg. Com. We ask for those before the order is placed rather than afterwards, because an invoice without the CUI cannot be deducted and would have to be issued again.

Delivery and collection

We deliver anywhere in Romania. You can also collect your order from the shop, which costs nothing and is usually the fastest way to get it.

Delivery is charged at a flat rate, shown in your basket before you pay anything. Orders over 150,00 lei are delivered free. Collecting from the shop is always free.

Delivery times are estimates rather than promises. The status in My account is your order's real state, and we email you each time it changes. We do not yet show live courier tracking on the site.

Somebody has to be there to receive the order. We sell food, including chilled and fresh items, and a courier cannot leave it on a doorstep. If a delivery fails because nobody was there or the address was wrong, we may charge for a second attempt, and perishable items may not survive to make one.

The goods become your responsibility once you or somebody at your address has taken delivery of them. They become your property once we have been paid in full.

Please check the order when it arrives. Anything wrong is quicker to put right the same day than a week later.

Age-restricted products

We sell alcohol only to people aged 18 or over. Ordering it is your confirmation that you are.

The courier or the shop may ask to see identification and may refuse to hand the order over without it. Where that happens the alcohol comes back to us and we refund it; the cost of the failed delivery may be kept. We will not sell alcohol to anyone who appears intoxicated, or where we have reason to believe it is being bought for someone under 18.

Changing your mind

Buying at a distance normally gives you 14 days from delivery to withdraw from the contract without giving a reason. That right is real and we honour it — but Romanian law itself withdraws it for goods that spoil quickly and for sealed goods that cannot be returned once opened for reasons of health or hygiene, which between them cover much of a grocery basket.

In practice that leaves it applying to sealed, shelf-stable items that are still sealed. You do not have to work out which of your items those are: the return form offers the option only on the ones it actually applies to.

To use it, sign in, open My account → Orders, find the order and start a return within 14 days of delivery. Send the goods back without undue delay afterwards. You pay the cost of returning them unless we have agreed otherwise.

We refund within 14 days of the goods reaching us, or of your proof that you sent them, whichever is sooner. If an item comes back showing more handling than was needed to see what it was, we may reduce the refund to reflect that.

If something is wrong with your order

This is the other kind of return, and it is not the same thing as changing your mind. If something arrived damaged, wrong, missing, past its date or not as described, tell us and we will put it right. It applies to everything we sell, fresh food included.

The windows run from delivery:

  • Fresh, chilled and other perishable items — 48 hours. Long enough to unpack a delivery the next day and find a problem; short enough that nobody is being asked to judge whether milk was already sour when it arrived.
  • Everything else — 14 days.

Open My account → Orders, find the order and start a return. You will be asked for at least one photograph of the problem and can send up to five. Those photographs are what let us settle most cases the same day, without anything having to travel back to us.

Depending on what happened we will replace the item, refund it, or make it good another way. You never pay to return something that was faulty or that we sent in error.

None of this limits the rights Romanian law gives you against a seller whose goods do not conform to the contract; those last longer than the windows above, and the windows exist so we can act quickly, not to cut anything short. If a window has closed and something is still wrong, contact us anyway and we will look at it.

Refunds

Refunds go back the way you paid. If you paid cash on delivery there is nothing to refund a card to, so we will ask for a bank account.

When you withdraw from a whole order we refund the standard delivery charge with it. When you keep part of an order, the delivery you have already had is not refunded.

Reviews and anything else you post

A review should be your own honest experience of a product you actually bought. Please do not post anything unlawful or abusive, anything containing another person's private details, or any claim that a food prevents, treats or cures a medical condition — that last one is not us being fussy, it is food law.

What you write stays yours. Posting it gives us permission to show it on the site alongside the product. You can edit or delete your own reviews at any time from My account → Reviews, and we may remove anything that breaks the rules above.

Using this website

The site is here for people shopping for themselves and their households. Please do not try to break into it or disrupt it, harvest the catalogue or its prices in bulk, or use it to resell our stock as your own shop. If you want to buy from us wholesale, ask — we would rather have the conversation.

We may withdraw access from anyone doing those things.

The text, photographs, layout, logo and name on this site are ours or used with permission. Product packaging and brand images belong to their manufacturers. Please do not copy any of it for commercial use without asking first.

What we are responsible for

If we break these terms or fail to use reasonable care, we are responsible for loss you suffer that is a foreseeable result of that.

We are not responsible for business losses — this is a shop for households — or for harm that comes from storage, preparation or allergen instructions on the packaging not being followed.

Nothing here limits anything the law does not allow us to limit. That includes liability for death or personal injury caused by our negligence, for fraud, for defective products, and for your rights as a consumer over food that is unsafe or not what it was sold as.

Some things are genuinely outside our control — weather, strikes, a supplier failing, a power or network outage. Where one of those delays your order we will tell you, and if the delay is substantial you can cancel and be refunded in full.

Your personal information

We use your details to take, deliver and account for your orders, and to answer you when you write to us. What we collect, why, how long we keep it and what you can ask us to do with it are all set out in our Privacy Policy.

If you are unhappy

Tell us first — most things are quicker to fix than to complain about. Use the contact page and include the order number. We answer complaints as soon as we have read them, and in any case within 30 days.

If we cannot settle it between us, you can take it to the Autoritatea Națională pentru Protecția Consumatorilor (ANPC) at anpc.ro, or to the alternative dispute resolution scheme ANPC runs, which settles consumer disputes out of court and free of charge. Going to either of those does not cost you the right to go to court instead.

Which law applies

Romanian law governs these terms and anything arising out of them, and the Romanian courts have jurisdiction. If you are a consumer living elsewhere in the European Union, you keep the protection of the mandatory consumer rules of the country you live in, and you can bring proceedings there.
